Terms of Service

You confirm that you are at least 18 and legally capable of entering this agreement; you have authority if acting for an organization; your information is accurate and kept current; and you will comply with laws that apply where you live and use the service.

Aiaimark is a digital software and API service delivered online. The operating entity and registered address are identified at checkout, on your payment receipt, or in a separately signed agreement.

What we provide

Aiaimark provides unified model discovery, API access, usage metering, account credit management, and related technical support. Available models, features, rate limits, and prices are shown in real time in the console or pricing page.

Third-party models

The service connects to third-party models, including providers identified on the platform. Provider performance, content policies, regional availability, and outages may affect service. We do not guarantee that a specific model will remain available permanently.

Changes

We may adjust models, interfaces, or features for security, compliance, provider changes, or product improvements. If a change materially impairs use of purchased credits, we will try to provide notice and a reasonable alternative.

• Register with a valid email belonging to you or an organization you are authorized to represent.
• Do not share credentials or expose API keys. Revoke compromised keys and contact us immediately.
• Do not place keys in public repositories, untrusted clients, logs, screenshots, or share them with unauthorized people.
• Do not create fake accounts, evade usage limits, transfer accounts, or help others bypass safeguards.
• You are responsible for loss caused by failing to protect credentials, except where law provides otherwise or our fault caused the loss.

The service uses prepaid, usage-based billing. One-time purchases add credits used for model calls and other clearly identified digital services. Current unit prices and billing units appear on the pricing page or in the console when a request is made.

• Credits are prepaid service units, not deposits, electronic money, or investments, and earn no interest.
• Credits are not transferable, saleable, or redeemable for cash except under the refund policy or applicable law.
• Promotional credits may have separate expiration dates and usage restrictions disclosed when issued.
• Charges depend on the selected model, input and output usage, and the displayed multiplier.

One-time authorization

Each credit purchase is a one-time transaction. Completing checkout authorizes the displayed amount, currency, and taxes. Purchases do not renew, auto-reload, or create recurring charges unless a future checkout explicitly discloses that feature and obtains separate authorization.

Processing

Waffo Pancake independently processes card payments under PCI-DSS requirements. Full card numbers do not enter or remain on our servers. Issuer, payment-network, and local rules may affect approval.

Prices and taxes

Unless stated otherwise, prices exclude applicable VAT, GST, sales tax, or similar charges. You are responsible for taxes properly charged for your purchase.

Purchased credits remain available while the account is active unless checkout clearly states a lawful expiration period. Closing an account does not automatically transfer unused credits to us. Contact billing support before closure to request any treatment available under these terms or applicable law.

Digital service credits generally become non-refundable once used. We may refund unused credits where required by law, after a verified duplicate or unauthorized charge, or when a service failure attributable to us materially prevents use and no reasonable remedy is available.

Submit requests to billing@aiaimark.com with the account email, order number, date, amount, and reason. Approved refunds return to the original payment method where possible.

Contact us before initiating a chargeback so we can investigate. We aim to respond within five business days and resolve the matter within ten business days. We may restrict an account while investigating a disputed payment, suspected fraud, or a reversed charge.

You retain rights you hold in inputs and, subject to provider terms and law, model outputs. You grant us only the rights needed to transmit, process, secure, and troubleshoot content while providing the service.

You are responsible for having rights to submitted content and for reviewing outputs before use. AI output may be inaccurate, incomplete, non-unique, or similar to content generated for others. The Aiaimark service, branding, software, documentation, and interfaces remain owned by us or our licensors.

You must follow our Usage Policy, applicable law, and relevant provider policies. You may not abuse the platform, bypass restrictions, expose keys, unlawfully resell access, or use the service to harm people or systems.

Our Privacy Policy explains how we process personal information. You are responsible for lawfully collecting and submitting data, giving required notices, and protecting your own applications and users. Do not submit regulated or sensitive data unless you have authority and suitable safeguards.

The service and model outputs are provided on an "as available" basis. To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. AI output is not a substitute for qualified professional judgment.

To the extent permitted by law, neither party is liable for indirect, incidental, special, exemplary, or consequential damages. Our aggregate liability is limited to amounts you paid for the service during the 12 months before the event giving rise to the claim, except where a limit is prohibited by law.

These terms apply while you use the service. We may limit, suspend, or terminate access for material breach, unlawful activity, security risk, non-payment, provider requirements, or legal obligations. Where practicable and lawful, we will provide notice and an opportunity to remedy.

You may stop using the service and request account closure. Provisions that by nature should survive, including payment, intellectual property, disclaimers, liability, and dispute terms, continue after termination.

The governing law and competent forum are those identified by the operating entity at checkout, on the payment receipt, or in a signed agreement, without prejudice to mandatory consumer protections. Before filing a formal claim, contact support and allow a reasonable opportunity for informal resolution.

• Changes: We may update these terms for product, provider, legal, or security changes. Material changes normally receive at least 14 days' notice unless immediate effect is legally required.
• Entire agreement: These terms, the Privacy Policy, Usage Policy, and referenced supplemental terms form the agreement between you and us.
• Severability: If a provision is unenforceable, the remaining provisions continue in effect.
• No waiver and assignment: Delay in enforcement is not a waiver. You may not assign the agreement without written consent; we may assign it with a merger, restructuring, or business transfer.
